1. Who these terms are with
These terms govern courier and transport services supplied by Herb'S Courier Services Ltd, a company registered in England & Wales under Company No. 17236658, whose registered office is 16 Hen Barc, Bangor, LL57 3RS ("we", "us", "our"). This website (hbcourier.uk) is operated by that company.
"You" means the person or business that books a job with us. Where you are booking as a consumer rather than for business purposes, the extra rights in clauses 8 and 9 apply and nothing in these terms reduces your statutory rights.
2. What we do, and what we do not do
We provide same-day dedicated delivery in North Wales, next-day parcel and pallet delivery to the UK mainland, multi-drop day-rate work, tail-lift pallet and bulky freight transport, delivery of time-critical documents, and hire of a van with a driver by the hour.
We do not provide house removals, packing services, storage or warehousing, and we do not carry anything that needs more than one person to lift safely. We do not carry the following at all:
- cash, bullion, jewellery over £500 in value, or bearer securities;
- livestock or living things;
- firearms, explosives, fireworks, or goods classed as dangerous under ADR;
- illegal or counterfeit goods, and anything requiring a licence you do not hold;
- perishable goods requiring temperature control.
If a consignment turns out to contain any of the above, we may refuse to carry it or stop the run, and the agreed price stays payable.
3. Booking a job
You can book by phone on +44 7853 151 457, by email to [email protected], or through the enquiry form on this website. The form is an enquiry only and does not create a contract.
A contract is formed when we confirm the job in writing (email or text) with a price and a collection window, or when we arrive and collect the consignment with your agreement. We may decline any booking, including where the timing is not achievable or the goods fall under clause 2.
4. Prices and quotes
The prices shown on this website are guide prices from which each job is quoted. Every job is priced individually and confirmed in writing before collection. A written quote is valid for 30 days and includes fuel; mileage beyond 15 miles is charged at the rate stated on the quote.
The quoted price may change only if the job changes — a different address, a heavier or larger consignment than described, extra drops, or waiting time beyond 15 minutes at either end. We will tell you before any additional charge is incurred wherever we can reach you.
We are not currently VAT registered, so no VAT is charged. If that changes, VAT will be shown separately on quotes and invoices from the date of registration.
5. Payment
Account customers are invoiced on the last working day of the month, payable within 14 days by bank transfer. Customers without an account pay on completion, by bank transfer or card link. We do not take payment through this website.
Late payments may carry statutory interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998 for business customers.
6. Collection and delivery
Collection and delivery times are given in good faith and we work hard to hold them, but they are estimates unless we have agreed a guaranteed time in writing. Time is not of the essence unless stated in that written confirmation.
You must:
- pack the consignment well enough to survive normal transport, and label it clearly;
- tell us the correct weight, dimensions and contents, and flag anything fragile;
- make sure someone can hand over and receive the goods at the times agreed, or tell us where a safe place delivery may be left.
If nobody is available at the delivery address and no safe place has been agreed, we will contact you and either return the consignment or attempt redelivery. A return or a second attempt is chargeable at the rate quoted.
Proof of delivery is a timestamped photograph plus the name of the person who received the goods, sent to you by email or text.
7. Delays outside our control
We are not liable for delays caused by events outside our reasonable control, including road closures on the A55 or Britannia Bridge, severe weather, accidents, vehicle breakdown despite proper maintenance, or your own delay in handing over the goods. Where a guaranteed timed delivery is missed for a reason within our control, the premium paid for that guarantee is refunded.
8. Cancellation
All customers. Cancel by phone or email. If you cancel before we set off there is no charge. If you cancel after we have set off but before collection, 50% of the quoted price is payable. After collection, the full price is payable.
Consumers. If you booked at a distance (online, by phone or email) as a consumer, you have 14 days from the day the contract is made to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. If you ask us to start within that period — which is usually the case with same-day work — you may still cancel, but you must pay for the part of the service already carried out. Once the delivery is fully performed within the 14 days at your express request, the right to cancel ends.
9. Refunds, claims and loss or damage
If something goes wrong, tell us as soon as you can. Damage or shortage must be noted at delivery where visible, and reported to us in writing within 7 days; non-delivery must be reported within 28 days of the collection date.
Where we are at fault, we will refund the charge for the job and settle the claim as set out below. For consumers, the Consumer Rights Act 2015 applies: if a service is not carried out with reasonable care and skill, you are entitled to have it put right or to a price reduction.
Our goods-in-transit insurance covers consignments up to £1,500 per consignment at their replacement cost. If your consignment is worth more, tell us before collection so cover can be arranged — otherwise our liability is capped at that figure.
10. Ownership and information you give us
The goods remain yours throughout. We take no title to anything we carry. You confirm you own the consignment or have the owner's authority to send it, and you are responsible for the accuracy of the addresses and contact details you supply. Any documents, photographs and records we create in carrying out the job remain ours, and we grant you a licence to use the proof of delivery for your own records and claims.
The content, layout and images of this website belong to us and may not be copied or reproduced without permission.
11. Limitation of liability
We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.
Subject to that, and to clause 9, our total liability for any one job is limited to the greater of the price paid for that job or £1,500 per consignment. We are not liable for indirect or consequential losses, loss of profit, loss of contracts or loss of business opportunity, whether or not we were told they were possible.
12. Data protection
Personal data given to us in the course of a booking is handled as described in our Privacy Policy.
13. Complaints and disputes
Raise it with us first, by email to [email protected] or by phone. We aim to acknowledge within 2 working days and resolve within 14. If we cannot agree, both sides may refer the dispute to mediation before starting court proceedings, and either party remains free to go to court.
14. Governing law
These terms and any contract made under them are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you may also bring proceedings in your own courts.
15. General
If any clause is found unenforceable, the rest stays in force. We may update these terms; the version that applies to your job is the one published when the booking was confirmed. These terms, together with our written confirmation of the job, are the whole agreement between us.
